to take under s.3 of the Crown Lands Resumption Ordinance,
No.10 of 1900, and s.14 of the New Territories Regulation
Ordinance, No.34 of 1910 for the resumption of these parcels
is wrongful. They allege further that the provisions of
these sections are inconsistent with the stipulation with
respect to expropriation contained in the Convention of 9th June, 1898, and that, consequently, the Ordinances in which they appear should not have received the assent of the
Governor unless they contained a suspending clause in
conformity with Article XXII of the Royal Instructions of
19th January, 1888. As a matter of fact no suspending
clause was contained in either of the abovementioned
Ordinances and they came into operation immediately on
their being assented to by the Governor in the ordinary
way. The Plaintiffs contend that the requirement as to a suspending clause is essential to the validity of any law falling within any of the catagories set forth in Article XXII of the Royal Instructions, and that the absence of such a clause invalidates the two Ordinances above mentioned
By his Statement of Defence the Defendant alleges
(1) That by s.14 of The New Territories Regulation Ordinance, No.34 of 1910, all land in the New Territories is
declared to be, and to have been as from the commencement of
the New Territories (Land Court) Ordinance, 1900, the property of the Crown, that the Plaintiffs are not the owners of the parcels above referred to and that any rights they ever possessed in the said parcels were derived under an Indenture of Lease dated the 18th March, 1905, and made between the Crown of the one part and one Wai U Yam Tong
of the other part;
(2) That acting under the powers conferred upon him by
s.3 of the Crown Lends Resumption Ordinance, 1900, the
Governor in Council has resumed possession of the said
parcels of land; and
